iRefr Recruitment Solutions Pvt Ltd provides this website, iRefr.com and all the services associated with this website. By using or logging onto the site, or by using any of the content on the site, the user agrees to the terms and conditions of the following agreement.

    1. You understand and agree that iRefr is an invite only website. Membership to iRefr is by invitation or application. Granting membership to users is the sole discretion of the iRefr team and iRefr reserves the right to refuse membership without revealing the reasons for doing so.
    2. iRefr Recruitment Solutions Pvt Ltd reserves the following rights:
  1. To change the terms and conditions of this document. It is therefore recommended that you visit this page periodically. Your use of the website after such changes constitutes your acceptance of the changes
  2. To change the access rules for the site
  3. To restrict/change any user from accessing the site
  4. To change the site in any way
  5. To delete any profile, job listings or any other postings from the site
    3. You agree to not access the unauthorized areas of the website. You also agree not to probe the website infrastructure for vulnerabilities to breach the security of the web site. You also agree not to send any unsolicited emails including but not limited to commercials, promotions. You also agree not to overload, hack or crash the server or any other web site infrastructure. Any such security violation will result in civil or criminal liability
    4. You are also prohibited from violating or attempting to violate the security of iRefr Site, including without limitation, the following activities:
  1. accessing data not intended for such User or logging into a server or account which the User is not authorized to access;

  3. attempting to interfere with service to any User, host or network, including, without limitation, via means of submitting a virus to the iRefr Site, overloading, "flooding", "spamming", "mailbombing" or "crashing"; or
  4. forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Violations of system or network security may result in civil and/or criminal liability. iRefr will investigate occurrences, which may involve such violations, and cooperate with law enforcement authorities in prosecuting Users who are involved in such violations.
    5. iRefr does not guarantee that your use of the website will be error-free, uninterrupted, safe from viruses or other harmful elements or that it is secure. Any opinions or ideas expressed on this site by visitors, employees of iRefr, or any other person does not create any warranty. The information posted on this site is not guaranteed to be accurate
    6. Because your authentication on the Internet is difficult, iRefr cannot and does not confirm that each user is who they claim to be. Because we do not and cannot be involved in user-to-user dealings or control the behavior of participants on the iRefr Site, in the event that You have a dispute with one or more user, You release iRefr (and our agents and employees) from claims, demands and damages (actual and consequential and direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes
    7. iRefr cannot guarantee and does not promise any specific results from use of the site. No advice or information, whether oral or written, obtained by a User from iRefr shall create any warranty not expressly stated herein

You agree not to sell or modify the iRefr Content or reproduce, display, publicly perform, distribute, or otherwise use the iRefr Content in any way for any public or commercial purpose, in connection with products or services that are not those of iRefr.com, in any other manner that is likely to cause confusion among consumers, that disparages or discredits iRefr or its licensors, that dilutes the strength of iRefr's or its licensor's property, or that otherwise infringes iRefr's or its licensor's intellectual property rights. You further agree to in no other way misuse iRefr Content that appears on this Site. The use of the iRefr Content on any other Web site or in a networked computer environment for any purpose is prohibited. Any code that iRefr creates to generate or display any iRefr Content or the pages making up the iRefr Site is also protected by iRefr's copyright and you may not copy or adapt such code

Usage of such material for any other purposes than the one authorized above is a violation.   2.  in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others, or
  3. that is defamatory, obscene, threatening, abusive or hateful
    10. You agree to sign up for no more than one account. Attempting to sign up for more than one account or providing inaccurate information when signing up for an account may result in the termination of your account. You agree not to post any inaccurate biographical information or information that is not your own resume. You also agree not to share your passwords with anyone else.

You agree to defend, indemnify, and hold harmless iRefr its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the website or your breach of the terms of these Terms. iRefr shall provide notice to you promptly of any such claim, suit, or proceeding and may, at iRefr's option, assist you, at your expense, in defending any such claim, suit or proceeding
    12. iRefr is not responsible for any incorrect or inaccurate Content posted on the Web site or in connection with iRefr.com, whether caused by users of the Web site, Members or by any of the equipment or programming associated with or utilized on iRefr.com. iRefr is not responsible for the conduct, whether online or offline, of any user of the Web site or Member of iRefr.com. iRefr is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to users and/or Members or to any other person's computer related to or resulting from participating or downloading materials in connection with the Web and/or in connection with iRefr.com. Under no circumstances will iRefr be responsible for any loss or damage, including personal injury or death, resulting from anyone's use of the Web site or iRefr.com, any Content posted on the Web site or transmitted to Members, or any interactions between users of the Web site, whether online or offline. The Web site and iRefr.com are provided "AS-IS" and iRefr expressly disclaims any warranty of fitness for a particular purpose or non-infringement. iRefr cannot guarantee and does not promise any specific results from use of the Web site and/or the Service. The service may be temporarily unavailable from time to time for maintenance or other reasons. No advice or information, whether oral or written, obtained by user from iRefr or through or from the service shall create any warranty not expressly stated herein.
    13. Except in jurisdictions where such provisions are restricted, in no event will iR efr be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Web site or the iRefr.com, even if iRefr has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, iRefr's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to iRefr for the Service during the term of membership.
    14. You agree that iRefr without obligation may review and delete any content, messages, images, descriptions of locations, geographical data or profiles (collectively, "Content") that in the sole judgment of iRefr violate of its Terms of Use or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of Members
    15. You are solely responsible for the Content that you publish or display on iRefr.com, or transmit to others
    16. You may not transmit any chain letters or junk email to others. Although iRefr cannot monitor the conduct of its Members off the Web site, it is also a violation of these rules to use any information obtained from iRefr.com in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. In order to protect our Members from such advertising or solicitation, iRefr reserves the right to restrict the number of emails which a Member may send to others in any 24-hour period to a number which iRefr deems appropriate in its sole discretion
    17. By visiting or using the Web site iRefr.com, you agree that the laws of the Govt. of India under Maharashtra State Jurisdiction, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and iRefr Recruitment Solutions Pvt Ltd or any of its affiliates. Any dispute relating in any way to the Web site and/or the iRefr.com (including your visit to or use of the Web site and/or iRefr.com) shall be submitted to confidential arbitration in Mumbai, India, except that, to the extent you have in any manner violated or threaten to violate iRefr Recruitment Solutions Pvt Ltd. or any of its affiliates' proprietary or intellectual property rights, we may seek injunctive or other appropriate relief in any state court of competent jurisdiction. For the purpose of such relief, you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non convenience with respect to, non-exclusive venue and jurisdiction in the state and central courts of India. Arbitration under this Terms of Use shall be conducted under the rules then prevailing of the Indian Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Terms of Use shall be joined to an arbitration involving any other party subject to these Terms of Use, whether through class arbitration proceedings or otherwise. Any claim, action or proceeding by you related in any way to the Web site and/or iRefr.com (including your visit to or use of the Web site and/or iRefr.com) must be instituted within one (1) year after the cause of action arose or be forever waived and barred.
    18. You agree that iRefr may, under certain circumstances and without prior notice, immediately terminate your iRefr account, any associated email address, and access to the site. Cause for such termination shall include, but not be limited to,
  1.  breaches or violations of the terms herein or other incorporated agreements or guidelines,
  2.  requests by law enforcement or other government agencies,
  3.  a request by you (self-initiated account deletions),
  4.  discontinuance or material modification to the service (or any part thereof),
  5.  unexpected technical or security issues or problems,
  6.  extended periods of inactivity,
  7.  engagement by you in fraudulent or illegal activities, and/or
  8.  nonpayment of any fees owed by you in connection with the services provided by iRefr.
    19. The Privacy Policy (the Policy) posted on the Site is incorporated into this Agreement by this reference. The Policy governs data collected through iRefr's on-line operations only. Please note, as set forth in the Policy, that iRefr may collect certain personal information from You and may contact You periodically in accordance with the terms of use. In addition, iRefr reserves the right to comply, in its sole discretion, with legal requirements, requests from law enforcement agencies or requests from government entities, even to the extent that such compliance may require disclosure of certain information collected from You
    20. You agree that a minimum of 10% of your reward amount earned on every successful referral made by you shall go towards the designated charity as a mandatory donation. You do have the option of increasing this donation percentage by choosing your donation percentage on the "my donations" page. Once set, this percentage shall be applicable to the forthcoming referrals made by you unless you decide to change the donation amount again.
